The Notification of the Ministry of Finance
Re: Classification of Inter-Dealer Brokerage as Securities Businesses
 
 
 

 

 

By virtue of Section 4 of the Securities and Exchange Act B.E. 2535, Finance Minister by the SEC’s recommendation hereby issues the following regulations.

 

 

Clause 1 In this Notification:

“securities dealer” means
(1) licensee to operate securities business in category of securities dealing;
(2) licensee to operate securities business in category of securities dealing under foreign law ;
(3) the Bank of Thailand.

 

Clause 2 Undertaking of inter-dealer brokerage shall be classified as securities business within the definition of securities business under Section 4(7) of the Securities and Exchange Act B.E. 2535.

 

 

Clause 3 Undertaking of inter-dealer brokerage under Clause 2 means providing of the services for consideration in forms of brokerage fee, other fees or other remunerations as a broker or an agent to effectuate trading in debt securities between dealers in normal course of business, the service of which is carried out by collecting information on offer for sale or purchase of such securities for dissemination to dealers and providing a system for matching orders placed between dealers or any systems to facilitate trading of securities between dealers.

 

 

Clause 4 This Notification shall come into force on the following date of its publication in the Government Gazette.
