SEC warns the public against activities that may constitute unlicensed digital asset business operations

Bangkok, 22 August 2025 – The Securities and Exchange Commission (SEC) warns the public to exercise caution against activities that may constitute the undertaking of digital asset businesses without licenses, as such activities may violate the law and be punishable by imprisonment and fines. This warning follows findings that certain individuals have provided digital asset trading and exchange services outside licensed digital asset exchanges. The SEC also urges the public and investors to be cautious when using the services of unlicensed digital asset business operators, as such services may not be protected by law and may expose users to fraud or scams, as well as being used as channels for money laundering activities. 

In light of information circulated on social media indicating that certain individuals are providing digital asset trading and exchange services outside licensed digital asset exchanges, the SEC hereby issues a warning that certain activities may constitute the undertaking of digital asset businesses without licenses. For example, operating digital asset trading or exchange services, acting as a digital asset broker, dealer or agent, and providing digital asset investment advisory services in the ordinary course of business. Such activities may constitute legal violations punishable by imprisonment and fines*. 

The SEC advises the public and investors to take precaution before using services provided by unlicensed digital asset business operators, as they may fall victim to fraud and scams. Note:  
* Pursuant to Section 66 of the Emergency Decree on Digital Asset Businesses B.E. 2561 (2018), any person who operates digital asset businesses without a license shall be liable to imprisonment for a term of two to five years, and a fine of 200,000 to 500,000 baht, and a further daily fine not exceeding 10,000 baht for every day during which the contravention continues.
