SEC files criminal complaint against As Sure Technology Co., Ltd., its directors and related persons for operating an unlicensed digital asset exchange business, and notifies access blocking effective 7 November 2026

Bangkok, 7 October 2026 – The SEC has filed a criminal complaint with the Economic Crime Suppression Division (ECD) against As Sure Technology Co., Ltd. (As Sure) and related persons, totaling five persons, for providing platform services through the website www.vcex.io and the VCEX application (collectively referred to as the Vcex.io platform), as their conduct constitutes the operation of a digital asset exchange business without a license, in violation of the Emergency Decree on Digital Asset Businesses B.E. 2561 (2018) (Emergency Decree). The SEC has also notified the Ministry of Digital Economy and Society (MDES) to block access to the platform.

The SEC found that, during the period from 24 December 2021 to 2 September 2022, As Sure, Mr. Sivanus Yamdee, and Miss Pimchaya Wattanakulyothin jointly provided services through the Vcex.io platform, which enabled users to trade or exchange digital assets by matching their own orders to buy, sell, or exchange digital assets on the platform. Fees were also charged as part of the ordinary course of business. In addition, the platform provided services in Thai and was promoted through events held at various locations in Thailand as well as through online channels. Such conduct constitutes the operation of a digital asset exchange business without a license, in violation of Section 26 of the Emergency Decree, and is subject to penalties under Section 66 of the Emergency Decree in conjunction with Section 83 of the Criminal Code.

In addition, at the time of the incident, Mr. Yutthana Srisuriyaporn, Mr. Sivanus Yamdee, and Mr. Keerati Prasanthai, were authorized directors and persons responsible for the operations of As Sure. Accordingly, all three persons are liable in the same manner as As Sure pursuant to Section 94 of the Emergency Decree.

The SEC has therefore filed a criminal complaint against the five persons, namely (1) As Sure, (2) Mr. Yutthana, (3) Mr. Sivanus, (4) Mr. Keerati, and (5) Miss Pimchaya, with the ECD for further legal proceedings.

Following the criminal complaint filed by the SEC, the criminal enforcement process will proceed with an investigation by the inquiry official, prosecution by the public prosecutor, and adjudication by the court of justice, respectively. In this regard, the SEC will monitor the progress of the legal proceedings and fully cooperate with relevant agencies to support legal enforcement under the Emergency Decree after the criminal complaint has been filed.   

In addition, the SEC has submitted information regarding the Vcex.io platform to the MDES for the purpose of blocking access to the platform. This action is in accordance with the Royal Decree on Measures for Preventing and Suppressing Technology Related Crimes (No. 2) B.E. 2568 (2025), which authorizes the MDES to order the blocking of unlicensed digital asset trading platforms to protect investors and prevent the use of unlicensed digital asset trading platforms for money laundering activities. As a result, public access to the Vcex.io platform will be blocked from 7 November 2026. 

The SEC also urges the public and investors to exercise caution when using services of unlicensed digital asset business operators, as they will not be protected under the law and may be exposed to risks of fraud and scams as well as money laundering activities.
