SEC public hearing on drafted regulations on granting of approval for derivatives regulatory association.

Bangkok, 26 September 2023 – The Securities and Exchange Commission (SEC) is seeking public comments on the principles and draft regulations regarding derivatives regulatory association (“association”), which include provisions on approval and supervision of the association in consistent with the International Organization of Securities Commissions (“IOSCO”) principles to ensure investor protection, promote fairness among members and market integrity.

On 3 August 2023, the SEC Board Meeting No. 12/2023 passed a resolution approving the principles and draft regulations related to application for approval and granting of approval for derivatives regulatory association. The main focuses of the proposed regulations are as follows:  

      (1) Application for approval and granting of approval for the association: An applicant shall be granted an approval for operating a derivatives regulatory association only upon meeting the criteria such as having good corporate governance structure, establishing rules for recruiting and supervising members that are transparent, fair and free from anti-competitive situations;  

      (2) Post-approval duties of the association: The association shall perform its duties in accordance with good governance principles and maintain compliance with the approval conditions at all times. In the event that its proposed rules would affect the business operations or the interest of members, investors or stakeholders, the association shall arrange a hearing with such persons and submit a report on such hearing to the SEC in support of the consideration for approval of the proposed rules.
