SEC public hearing on draft amendments to the reporting rules and reporting forms of securities and derivatives business operators

Bangkok, 20 May 2024 – The Securities and Exchange Commission (SEC) is seeking public comments on proposed principles and draft amendments to the regulations related to reporting rules and reporting forms of securities companies and derivatives business operators (“business operators”). This is to provide the SEC with in-dept information for supervising risks of business operators and the capital market. Additionally, the proposed amendments would set relevant information standards to support SEC Open Data Services, to accommodate the exchange of information according to investors’ future demands. 

The SEC emphasizes the monitoring of risks related to capital market and the development of digital capital market, covering the areas of supervision, service provision of business operators, and the use of financial services by investors. The SEC is therefore proposing to amend the reporting rules for business operators. Currently, the existing regulations require that business operators prepare and submit a monthly report of aggregated data and update the system each time the reporting forms are revised. The proposed amendment involves submitting granular data with specified details and data frequency, aiming to provide the SEC with processed data to facilitate more efficient capital market risk assessment in various aspects. 
 
The SEC is proposing to amend the reporting rules and establish data sets and standards for certain information. The key points are summarized as follows:
          (1)  To revise the reporting scope for business operators to include the submission of data or documents, limited to what is necessary and within an appropriate timeframe, to enable the SEC to fulfill its legal duties for the public interest or investor protection;
            (2)  To revise the client asset and transaction reports for business operators, requiring detailed data broken down by each individual client and each security. Business operators would be required to submit these reports to the SEC on a weekly basis within two business days.
