SEC public hearing on a proposed amendment to the regulations regarding advertising warning statements on investment risks for digital tokens

Monday 16 September 2024 | No. 191 / 2024

Bangkok, 16 September 2024 – The Securities and Exchange Commission (SEC) is seeking public comments on a proposed amendment to the regulations regarding warning statements on investment risks for digital tokens. Such amendment aims to enhance the advertising guidelines for ICO portals and ICO issuers.

Currently, the SEC regulations related to the advertising of ICO portals and ICO issuers require warning statements on investment risks for digital tokens. However, there are still advertisements without warning statements or warning practices are unclear. The SEC is therefore conducting this public hearing on a proposed amendment to the relevant regulations to establish a clear standard of warning presentation formats and clear presentation measures regarding warning on investment risks. The proposed amendment requires ICO portals and ICO issuers to put in place appropriate warning statements under the same standard and clearer warning presentation regarding investment risks. This is to ensure that investors have sufficient information regarding risks or limitations prior to using services or making investment decisions on digital tokens.

The consultation paper is available at the SEC website: https://www.sec.or.th/TH/Pages/PB_Detail.aspx?SECID=1017 and the legal hub: https://law.go.th/listeningDetail?survey_id=NDM0M0RHQV9MQVdfRlJPTlRFTkQ=. Stakeholders and Interested parties are welcome to submit comments and suggestions via the websites or email: sorawitp@sec.or.th and chawin@sec.or.th. The public hearing ends on 16 October 2024.
