SEC public hearing on proposed amendments to the regulations regarding advertising of digital asset business operators to promote responsible advertising practices

Bangkok, 15 January 2025 – The Securities and Exchange Commission (SEC) is seeking public comments on proposed amendments to the regulations regarding the advertising of digital asset business operators to build investors’ awareness of the risks associated with digital asset investments and enhance digital asset business operators’ responsible advertising practices.  


The SEC’s monitoring of digital asset developments and advertisements of digital asset business operators have shown that the current criteria for the formats and the practices of presenting risk warnings on investment risks through advertisements of digital asset business operators tend to be inflexible in certain areas and may be inconsistent with their business nature.

To ensure that digital asset business operators provide appropriate risk warnings to investors, raise awareness of the risks associated with investing in digital assets, and promote the creation and dissemination of responsible advertising in line with the expectations of the SEC, as well as to enable digital asset business operators to act appropriately in accordance with the nature of their businesses, the SEC is inviting public comments on the proposed amendments to the regulations regarding  advertising by digital asset business operators. The key points are as follows:
          (1) Adjust the font size of the warning notices in the advertisements to comply with securities regulations and align with advertising practices;
          (2) Remove the requirement for continuous warning notices during the advertisement, as the current principle-based advertising guidelines are sufficiently appropriate and consistent with securities regulations;    
          (3) Standardize the warning notices as a single, most stringent format that covers both cryptocurrencies and digital tokens, in line with the current practices of digital asset business operators;
          (4) Amend the regulations regarding social media advertisements to align with the adjustments according to Items (1) to (3) above.
