SEC Board resolves to extend the deadline for ERX Co., Ltd. (ERX) to remedy its capital maintenance deficiency until 30 March 2026

Bangkok, 16 February 2026 – The Securities and Exchange Commission (SEC) earlier required ERX Co., Ltd. (ERX – operating under the trade name “KuCoin Thailand”) to regain its capital maintenance in compliance with the prescribed regulatory requirements by 12 February 2026, pursuant to a prior resolution of the SEC Board*, to ensure that ERX maintains sufficient capital to continue its business operations. On that date, ERX submitted a request to the SEC seeking an extension of the deadline to remedy its capital maintenance deficiency.

The SEC Board, at the meeting on 16 February 2026, acting under Section 35(1) of the Emergency Decree on Digital Asset Businesses B.E. 2561 (2018), resolved to extend the deadline for ERX to regain its financial position, with completion required by 30 March 2026. The SEC Board also acknowledged the remediation of ERX’s board governance, whereby ERX demonstrated an approach for appointing replacement directors for those who had resigned, in order to comply with the requirements under Clause 9/1 of Notification No. KorThor. 19/2561. 

In this regard, the SEC places importance on closely monitoring the operations of business operators, including the daily monitoring of reports relating to client assets, to ensure compliance with the prescribed regulatory requirements.
