SEC files criminal complaint against 6 UKEM share price manipulators

Bangkok, September 9, 2014 - The SEC today filed a criminal complaint with the Department of Special Investigation (DSI) against {A} and {B}, former executives of United Securities Plc., {C} {D} {E} and an unknown person, for manipulating share price of Union Petrochemical Plc. (UKEM).

With the referral from the Stock Exchange of Thailand on irregular trading in UKEM shares by a group of persons during July 21st August 20, 2008, the SEC probed into the case and found that {A} {B} {C} five other accomplices, and another unknown person had colluded to trade UKEM shares through seven persons' securities trading accounts. They traded UKEM shares in concealment on a continual basis and matched orders within the group to mislead the general public in UKEM share trading values and volumes, causing inconsistency with normal market condition. The scheme was aided or abetted by {D} {E} and five other persons.

Their actions were in violation of Sections 243 in conjunction with Section 244 of the Securities and Exchange Act B.E. 2535 (1992) in conjunction with Sections 83 and 86 of the Penal Code. As {A} {B} {C} {D} and {E} declined to enter the settlement procedure, the SEC therefore filed criminal complaint against them with the DSI for further legal proceedings.

During the legal proceedings, {A} and {B} are deemed as having prohibited characteristics of capital market personnel and untrustworthy characteristics of a publicly held company?s director and executive. Previously, both persons were named in the criminal complaints for manipulating the share prices of Metro Star Property Plc. (METRO), Thai Unique Coil Center Plc. (TUCC), S.E.C. Auto Sales and Services Plc. (SECC), and Rich Asia Steel Plc. (RICH).

In any case, filing a criminal complaint commences the criminal justice administration whereby the court will judge the case accordingly.
