SEC public hearing on draft regulations relating to capital requirement

Bangkok, 19 May 2020 – SEC is seeking public comments on the proposed regulations relating to net capital (NC) requirement for securities and derivatives business operators. The revision is intended to support the use of subordinated facility as a tool for immediate increase in transactions and the calculation of NC for digital asset businesses.

Earlier, SEC had considered the amendments to the rules relating to net capital requirement for securities and derivatives business operators, and published a public hearing in 2019 which covered the proposals on the calculation of subordinated facility to support an immediate increase in transactions, as well as the calculation of digital asset business risk and business suspension for any business operator having NC below the minimum requirements.

Now, SEC has drafted related regulations by taking into account the concerns and suggestions raised by the private sector during the public hearing last year in order to make the rules practical for the business operators.
