SEC proposes and seeks public comments on “measures for witness protection in capital market cases”

Bangkok, 14 October 2020 – SEC proposes measures for witness protection in order to increase the efficiency of law enforcement and provide protection to informants and witnesses in capital market cases. Under the proposed measures, the protection will extend to cases which are still under SEC’s investigation. SEC invites public comments on this matter. SEC will also hold a hearing with focus group which includes public, and related private and public sectors on 22 October 2020.

The Office of Securities and Exchange Commission (SEC) is considering amendments to the laws administered by SEC in order to increase the efficiency of law enforcement. The Agency proposes to establish witness protection measures which can be granted during the stage of SEC’s investigation. The measures will provide SEC another prospect to obtain credible information and evidence that will enable the Agency to bring more legal actions, either criminal or civil, against offenders. Whereas the informants or witnesses, who provide information or evidence to SEC official, will receive protection for safety of his/her life and property. 

SEC invites public comments on the proposed witness protection measures that will be added into 4 Acts* administered by SEC. The Agency will, in addition, hold a holding a hearing to seek comments from public, and related private and public sectors on 22 October 2020 from 2:00 p.m. - 4:30 p.m. at SEC office. Interested parties can reserve seats at 0-2263-6553 or e-mail to pitchayai@sec.or.th
