In
recent years, Thailand’s investment management business has continued to grow
and has played an important role in public savings and investment. Meanwhile,
fund products have evolved and become more complex, both in terms of the types
of assets in which funds may invest and product structures, including the classification
of investment units (unit classes) to accommodate the different needs of
investors. The SEC therefore proposes amendments to the regulations and
reporting forms related to the investment management business to align with
these developments. The key elements are as follows:

Require the use of the International Securities Identification Number (ISIN
Code) as the primary reference identifier for each fund or unit class to enable
more accurate identification and data linkage, particularly for funds with
multiple unit classes or changes in unit class abbreviations.
(2)
Amend seven groups of reporting forms to accommodate information at the unit
class level, new types of assets in which funds may invest, and asset details
that more clearly reflect characteristics and liquidity risks. These amendments
would also provide the SEC with the information necessary for appropriate and
timely supervision, risk monitoring and investor protection.
(3)
Change the report submission channel from the One For All Reporting System
(OFAR) to the E-Reporting system to reduce duplication of reporting channels
and lower business operators’ expenses from using Digital Signature
Certificates under the existing system.
In
addition, the SEC proposes to amend the capital maintenance regulations
applicable to business operators engaging in mutual fund management, private
fund management, brokerage, dealing and underwriting of investment units, as
well as derivatives fund management, by including GHB savings certificates
within the definition of “deposits or deposit-equivalent instruments.” Such
certificates would therefore be eligible for inclusion in capital calculations,
thereby providing business operators with greater flexibility in capital
management.
