SEC public hearing on proposed principles for amending the Emergency Decree on Digital Asset Businesses for greater alignment with current situations

Bangkok, 23 May 2024 – The Securities and Exchange Commission (SEC) is seeking public comments on the regulatory impact assessment of the Emergency Decree on Digital Asset Businesses B.E. 2561 (2018) (“Emergency Decree”) to review and enhance the assessment criteria to be more appropriate and consistent with the current situation, thereby increasing the supervisory efficiency. Additionally, the proposed amendment seeks to strengthen investors’ confidence in digital asset investment.

The evaluation of the legal effectiveness of the Emergency Decree is due under the Act on Legislative Drafting and Evaluation of Law B.E. 2562 (2019) (“the 2019 Act”), which requires that government agencies evaluate the effectiveness of a law at least every five years from the effective date of the law or every other periods as specified in the governing ministerial regulations or upon occurrence of other cases as specified in the 2019 Act.

The SEC is therefore conducting this public hearing on the challenges and impediments related to the Emergency Decree and associated regulations. The feedback will be considered in evaluating the issues, assessing their necessity, ensuring consistency, and addressing law enforcement obstacles. The goal is to enhance the governance of digital assets to be more efficient to foster trust and confidence in the Thai digital asset market among investors.
